Device Repair Consent & Liability Waiver

These terms apply to store drop-off and mail-in repair requests with The Phone Zone Ltd. They explain the repair risks and responsibilities. Your approved quote or work order records the specific work, charges and repair warranty.

Ownership & Work Authorization

I own the device or have permission from its owner to submit it for service. I request an assessment of the reported issue and authorize visual inspection and non-destructive testing when the device is received. This submission does not authorize chargeable diagnosis, opening the device or repairs. The Phone Zone must explain the proposed work and charges and obtain my approval before proceeding. Additional work or a change in price requires further approval.

Device Condition & Disclosures

I will disclose known damage, liquid exposure, earlier repairs, intermittent faults, account locks and battery concerns. The Phone Zone may record the serial number or IMEI, relevant test results and photographs of the device’s physical condition for the service record. A device that cannot power on or be fully tested may have existing faults that only become apparent during assessment or repair.

Data, Backups & Access

I am responsible for backing up my data where possible and removing physical SIM and memory cards before handing over the device. I will tell the team if a backup cannot be completed. Diagnosis, repair, software work or replacement can involve data loss or a reset; data preservation and recovery are not guaranteed or included unless expressly agreed. Any proposed reset requires my approval. I will not submit account passwords, passcodes or sensitive device content through website forms. Any access needed for testing will be arranged separately and limited to the agreed service.

Pre-Existing Damage & Repair Risks

Cracked glass, weakened frames, liquid corrosion, worn components and earlier repairs can make a device fragile. Existing damage may worsen or hidden faults may emerge during otherwise careful, approved work. The Phone Zone will explain any particular risks identified before proceeding and document testing limitations. It does not guarantee a successful repair or the operation of unrelated functions that could not be tested. A fault discovered after a repair will be assessed on its circumstances; it is not automatically treated as pre-existing or excluded from coverage.

Replacement Parts, Seals & Repair Warranty

The type of replacement part, any known effect on device features, and the repair warranty must be explained before I approve the work. Opening or repairing a device may affect its seals; factory water resistance is not promised after repair unless expressly confirmed in writing. The repair warranty is the coverage stated in my quote, work order or receipt, together with any rights required by law. Device-sale and accessory-sale warranties do not automatically define the warranty for a separate repair service.

Repair Prices, Payment & Mail-In Service

Listed repair prices are shown online before applicable taxes. I choose store drop-off or mail-in service before submitting. Mail-in repair service costs an additional $40, including shipping to The Phone Zone and return shipping within Canada. The total before tax is shown with my request. The Phone Zone confirms the selected work and any applicable taxes, then emails the shipping label and instructions. For unlisted repairs, I must request availability and pricing through Contact Us. Any diagnostic fee must be disclosed and agreed in advance, including any fee that applies if the repair is unsuccessful or declined. Return shipping is included in the $40 mail-in fee if the repair cannot proceed. Additional work or a change in price requires my approval. Payment for a completed repair is due after repair and testing, before return dispatch. Delivery and repair times are estimates unless expressly agreed otherwise.

Limited Liability Waiver

To the extent permitted by applicable law, I accept the specific repair risks disclosed to me and waive claims against The Phone Zone Ltd. arising solely from pre-existing damage or unavoidable technical risks of work I approved that was performed with reasonable care. This includes data loss attributable solely to those risks. The Phone Zone is not responsible for pre-existing faults it did not cause or for indirect losses, such as lost income or business interruption, arising solely from those faults or delays outside its reasonable control. This waiver does not release liability for the store’s negligence, fraud, wilful misconduct, unauthorized work or unauthorized access to data, and does not reduce an express warranty or remedy required by law.

Your Legal Rights & Questions

Nothing in this waiver removes rights, benefits or protections that cannot be waived under Alberta’s Consumer Protection Act or other applicable law, including mandatory protections that apply to customers in other provinces. Ask the team to explain any term before accepting. Your specific repair authorization and written coverage terms must be kept with this waiver; accepting the waiver alone does not approve a repair or its price.

Your Acknowledgement

I am the device owner or am authorized by the owner. I have read and agree to the Device Repair Consent & Liability Waiver, including the disclosed repair risks and limited liability terms. I understand that this submission requests an assessment and that chargeable work, opening the device and repairs require my separate approval.

Acceptance is recorded when you submit the repair form. Please keep your repair reference and approved quote.
